Unfair Contract Term Reforms Commenced 10 November 2023 - Don’t Let Your Project Get Caught!

AIQS, together with Lynch Meyer Lawyers, are pleased to offer a presentation to members on the important new Unfair Contract Term reforms.

The Unfair Contract Term legislation invalidates certain unfair contract terms and creates penalties for businesses who use unfair terms in their contracts. These reforms, effective from 10 November 2023, significantly expand the types of contracts caught by the legislation and proscribe increased and additional penalties.

The reforms expand the application of the legislation to standard form contracts where one party has fewer than 100 employees or has a turnover of less than $10,000,000.

It is commonplace for clients to use standard form contracts. QS’s need to be particularly aware of these new changes and the risk!

The presentation will cover changes to the law and provide helpful tips and guidance as to what sort of terms may fall foul of the legislation.
