Termination of Construction Contracts under FIDIC Forms in the UAE
This AIQS conference brings to light the need to have a better understanding of termination provisions of contracts and its rightful implementation procedure.
Court orders may terminate the construction contract (muqawala) if either party violates one of the responsibilities outlined in the contract, which is a circumstance where the construction contract outlines the parties’ rights and obligations. As a result, the opposing party might apply to the court or arbitral tribunal for a decree of contract termination. In light of this, even if the parties agree on the termination clause, a court order or arbitral decision may only verify the actual termination.
Specific topics that will be dealt with include:
- Contractual Background / interpretations shortcomings in provisions of Standard Forms of Contract
- Practical aspects and approach adopted by the Common Law and its influence on the UAE common law jurisdictions (DIFC and ADGM Courts)
- Approach of the UAE Courts in relation to the termination of construction contracts (muqawala)
