The New Terrain of Latent Conditions Claims

This joint seminar with the Chartered Institution of Civil Engineering Surveyors (CICES) will focus on new technologies that improve early-stage design and decision making, and the flow-on effect that this could have on latent conditions claims.

Latent conditions claims and associated cost over-runs continue to plague the construction industry in Australia. A recent independent audit of the $120 billion Federal infrastructure pipeline found $33 billion in forecast cost over-runs.

Latent condition terminology in contracts is almost 50 years old. Recent case law has moved the boundaries for both client and contractor - this seminar will review those developments and suggest new approaches to latent condition risk.

About the speakers:

As a contract practitioner, David focusses on de-risking projects at an early stage resolving disputes in a fair and timely manner. David is a co-founder of Inframara Pty Ltd, which is an infrastructure advisory company specialising in early contractor involvement and collaborative contracting.

Jason Errey, Director, OEMG Global Jason delivers advanced digital ground modelling on projects and mega-projects in Australia and throughout the world. For the last 10 years, Jason has focused on developing novel digital geophysical technologies and integrating this into a ground modelling process that will improve economic and environmental sustainability as well as customer outcomes.
