This webinar will focus on the key insolvency challenges facing the construction industry. Attendees will gain insights into the alarming insolvency statistics in the industry, relevant laws like the Corporations Act, the SOPA (and its recent amendments), and the Murray Report's recommendation advocating for a QLD-like trust monies system. The seminar will also cover the protective mechanisms found in Major Work Subcontract clauses to safeguard Head Contractors from Trade Contractor insolvency risks.

Consideration will be given to how liquidator behaviours are being used to leverage the SOPA. Additionally, participants will learn about the recovery of security monies under the SOPA.

Lastly, the Seminar will address the role of expert evidence in adjudication determinations. Reference will be made to the recent Supreme Court decision of Canterbury Bankstown Council v General Works, which suggests that where a contract is silent as to valuation, an adjudicator will use a Quantity Surveyor report to come to a determination.
