An Overview of Security of Payment Legislation

Subsequently, all Australian states and territories have adopted their own version of security of payment legislation, and there are substantial differences between jurisdictions. Understanding these differences is essential for those who operate in multiple jurisdictions

Mr Russell Welsh will provide an overview of the security of payment landscape within Australia, outlining the differences between jurisdictions and the attempts made to harmonise the legislation nationally. Additionally, Russell will explore the role of the QS and AIQS in the security of payment process in Queensland.

Russell Welsh MSc, FAIQS, CQS, FRICS, FCInstCES Russell is a director of Australian Building & Construction Dispute Resolution Service Pty Ltd (ABC DRS). He is a certified quantity surveyor, chartered quantity surveyor, chartered project management surveyor, and civil engineering surveyor, specialising in dispute resolution. Russell has more than 48 years industry experience internationally, including 34 years in Australia. He is an adjudicator in all states and territories of Australia, and over the last 18 years has managed two ANA’s. ABC DRS provides regular security of payment training for NSW, QLD & WA jurisdictions.
