On Wednesday 30 March 2022, members can attend a mock construction arbitration, with a panel of experienced participants led by leading Arbitrator, Russell Thirgood, construction Barristers and Solicitors and AIQS expert witnesses. 

The event will start with an overview of the dispute (a fictional factory extension where arguments about payment have arisen) and how the arbitration process works. The Narrator will then provide commentary as the participants take us through a short case management conference, before progressing through the hearing where Counsel will cross-examine the witnesses and conclude with short oral closing submissions.

About the Arbitrator

Russell Thirgood
Chartered Arbitrator, Thirgood Dispute Resolution Pty Ltd

Russell Thirgood is a Chartered Arbitrator who specialises in Construction & Infrastructure, Energy, Natural Resources and Commercial disputes, with an office in Brisbane and Chambers in London.

Russell is experienced in resolving complex and high-value commercial disputes. He has conducted cases throughout Australia, the Pacific, Asia, US, UK, Middle-East and Europe, under some of the key international and domestic arbitral institutional rules. He has been appointed by parties jointly and arbitral institutions, including the ICC and ACICA.

Russell was recently awarded ‘International Arbitrator of the Year - Brisbane’ by Best Lawyers Australia.

With over 20 years Commercial Management experience in the construction industry, Peta’s current role with McConnell Dowell as Program Commercial and Governance Manager on their Level Crossing Removal Alliance draws on her strong Quantity Surveying background and wealth of experience in Head and Subcontract management. She has managed all commercial aspects of a wide variety of projects procured under various contractual models including Lump Sum, D&C, MC, ITC and Cost Plus. Some of her recent major project experience includes the West Gate Tunnel Project in Melbourne, APLNG and Queensland Children’s Hospital here in Queensland.

 

 

 

 

Charmy Patel, MAIQS
Manager, Secretariat

Charmy currently works as a Manager with Secretariat specializing in Quantum Expert Witness services on construction disputes. Her experience working for well-regarded Contractors and Consultants on projects ranging from pre-contract stage to post contract dispute resolution underpin her core expertise in Construction Economics and Management. With her experience focused on the Infrastructure and Civil sector, Charmy has carried out the many roles of a Quantity Surveyor, and is a Member of the Australian Institute of Quantity Surveyors (MAIQS).
