This CPD event is focussed on providing an understanding of the management of Delay and Disruption Claims in construction, with particular reference to the UAE construction industry.

By attending this event, quantity surveying practitioners and contract administrators will refresh their knowledge of this important subject, and learn methods that they can implement in their workplace.

Specific topics that will be dealt with include:

  • The shortcoming in Extension of Time (EOT) provisions of standard forms of contract.
  • A consideration of the approaches that have been adopted by UAE Courts in relation to delay or disruption analysis (participants will benefit from tips and pointers as to how the local courts scrutinise such analysis under UAE Law.)
  • Matters regarding time - Extension of Time, Programme, Delay and Disruption.
  • Delay analysis for Arbitration (As Planned versus As Built).


ABOUT THE SPEAKERS

Prof. Indrawansa Samaratunga DSc
FRICS, FAIQS, FIQSSL, FCIArb, FCIOB, FCMI, FASI, FCABE

Prof. Indrawansa (Sam) Samaratunga is a Fellow of AIQS and also a Fellow of RICS, CIOB and CIArb. His 56 year career in Quantity Surveying, Contract Administration and Dispute Resolution spans over 25 years in the UAE, 22 years in Oman and 9 years in Sri Lanka. He is a registered arbitrator with the Dubai International Arbitration Centre and the London Court of International Arbitration.

 Prof. Sam was the first Middle East Representative when the Australian Institute of Quantity Surveyors launched its Middle East chapter some 17 years ago.
 
Prof. Sam is a regular Speaker at CPD events. Over 6000 practitioners have been through his training programme series "Sound Contract Administration".

Ali AlAidarous

Ali AlAidarous is the founder and managing partner of ALAIDAROUS Advocates and Legal Consultants, which has been in operation for over 25 years. He is one of the pioneers and prominent figures of international arbitration in the UAE.

His experience includes acting and appearing as counsel before the Dubai Courts, and appearing before various arbitration institutions including the ICC, DIAC, DIFC-LCIA and more. He is also admitted to the bar of the DIFC Courts as a registered Part II practitioner. Mr. AlAidarous’ practice is split into three heads: acting as an arbitrator; acting as an expert witness on UAE law, and appearing as counsel.

A UAE advocate, admitted to appear before the courts and judicial bodies of the UAE since 1993, Mr. AlAidarous had previously gained in-house experience working with Société Général. He has served as the UAE representative at the International Chamber of Commerce (ICC) in Paris, France, where he was part of the task force for making a final review of all ICC awards.

Michael Davies

Michael is the UAE Country Director for Quantum Global Solutions, responsible for the development of business and the management of over 20 employees. He has over 17 years of experience in commercial and claims management internationally. He has a wide range of experience from quality monitoring, project and contract management to construction law including various forms of building contracts.

He has prepared numerous claims for extensions of time, disruption, acceleration, quantum for prolongation, variation costs, loss and expense and has acted as party appointed expert as well as assisting Quantum’s Experts in the preparation of arbitration ready documents including the preparation of statement of claims on behalf of contractors. Michael has also received party appointed instructions for the preparation of a preliminary quantum reports for use by litigation funders in arbitration proceedings.

Michael has worked for a number of clients such as Vodafone, Education Funding Agency, Ministry of Defence, various housing associations, the Shangri-La Hotel, private developers and a multitude of multi-billion-dollar turnover contractors and sub-contractors across the Middle East and Far East.

Justin Spruit

Justin is the Associate Director of Forensic Planning in UAE for Quantum Global Solutions. He has over 18 years of experience in planning and the generation and defense of extension of time claims. Justin acts as an independant expert witness and has been appointed to the DIAC on several occasions, where he has also participated in cross-examinations.

He has recently been working as a commercial manager responsible for the day-to-day contract management including the preparation of independent expert reports. Justin is experienced in all delay methodologies, having implemented these on a wide range of projects. 

Justin has been working as a forensic planning claims consultant full-time for almost six years after having had significant success in the preparation and defence of claims as a senior planner. Justin has previously assisted in the preparation of expert reports in support for arbitration.
