This session will discuss the proposed changes (including new offences) to the BIF Act, QBCC Act and Building Act currently before parliament including:

  • Chapter 2 BIF Act - Statutory Trust Account model that will completely replace the Project Bank Account model;
  • Chapter 3 BIF Act – changes to Progress Payments and the adjudication process;
  • QBCC Act – changes to licensing obligations, due diligence obligations and notification obligations;
  • Building Act – changes to certification requirement and processes.

Common problems that we are seeing with the adjudication process and some key court decisions handed down since commencement of Chapter 3 BIF Act in December 2018 will also be covered.
