
Webinar: Use of ADR Methods in FIDIC Contracts Provisions - International Chapter - Region 2

In this session, our three expert speakers will consider the underlying principles of various Alternative Dispute Resolution (ADR) methods (negotiation, mediation, conciliation, adjudication / Dispute Board practice and arbitration) and will identify the contractual clauses and systems in various FIDIC contracts that facilitate such ADR methods.
ADR has gained widespread popularity in resolving commercial disputes where parties to a dispute (disputants) are interested in fixing their disputes in an expeditious and cost-effective manner as an alternative to litigation.
ADR methods typically provide a wide range of dispute resolution processes and techniques for disputants to settle their disputes outside the courtroom with the help of a third party who would play role of a neutral or a facilitator. It is worth noting that resolving disputes by ADR methods is nowadays widely promoted by courts of law.
About the speaker:
Mr Tilak Kolonne
Mr Tilak Kolonne is a Quantity Surveyor by profession. He is currently a freelance consultant and a practicing Dispute Board Member/ Adjudicator, Mediator and Arbitrator with over 30 years of international experience in the construction industry. He has gained substantial academic knowledge in law of contract, law of tort and law of evidence.
Mr Kolonne is engaged in various construction projects in contract administration, dispute avoidance and resolution in the capacity of Arbitrator, Adjudicator and as party representative / consultant.
Dr Saman Mahawatta
Saman has over 28-years experiences in both the Quantity Surveying and Civil-Engineering fields. He is Deputy-General-Manager in Maga-Engineering and Director in SNA-Holdings. Saman is a qualified QS and Civil-Engineer. Saman earned his BSc in QS, BSc in Civil-Engineering, BSc in BA, MSc in PM, MSc in Construction-Law-and-Dispute-Resolutions, MBA and PhD. Saman was given a knighthood for his achievements and his services to society.
Mr Duminda Dissanayaka
Duminda is a senior contracts and commercial manager, currently executing duties as the Managing Director of EXCOM Consultants, overseeing the Sri Lanka, UAE and KSA branches. Duminda has a robust quantity surveying background holding a BSc (Hons) degree in QS, and currently reading for MSc in Construction Law and Dispute Resolution. Duminda is involved with honorary services acting as the Secretory–AIQS Sri Lanka Branch of International Chapter-Region 2 and serving as an APC Assessor for AIQS.
