
AIQS QLD Chapter: Mock Mediation
Join us for a mock construction mediation, featuring a panel of experienced participants including a leading Mediator, AIQS expert witnesses, a construction Barrister and construction Solicitors.
The event will begin with an overview of the dispute (concerning a fictional construction plant manufacturer where various arguments have arisen), followed by an explanation of how the mediation process works. The narrator will then provide commentary as the participants take us through the process from commencement, through joint sessions and conclaves where the mediator will attempt to assist the parties to narrow the gap of their disagreement. The mediation will (hopefully) conclude with the parties reaching a binding settlement agreement.
ABOUT THE SPEAKERS
![]() | In the role of Mediator - Toby Boys Toby is recognised in the 2020 edition of Doyles Guide as leading Mediator for Queensland. He is regularly appointed by parties and nominating authorities to act as an independent mediator and facilitator. He was formerly a dispute resolution adviser with Europe’s largest ADR organisation, the Centre for Effective Dispute Resolution (CEDR), in London. Toby acts for clients in commercial dispute resolution matters in courts, tribunals and arbitrations including in mining, property and leasing, commercial, corporate, insolvency, intellectual property, regulatory inquiries and mediations. |

![]() | In the role of AIQS Expert Witness - Joel Glover MAIQS Joel Glover is a director in Secretariat’s Brisbane office specialising in dispute resolution and quantum services. Joel has over 17 years of practical experience working within the construction industry providing cost consulting and dispute resolution services in Australia, UK, and Europe. He has a broad experience of working with all parties to construction projects and legal representation across several forums and has considerable experience in the preparation of expert opinion and reports in connection with construction disputes and providing expertise on contract change, claims assessments and EPC contractor negotiations. |
![]() | In the role of Barrister - Thomas Ambrose Thomas has a civil and commercial practice with a focus on disputes involving construction and infrastructure projects. At the bar, Thomas has appeared for parties at mediation, arbitration and court (Queensland and interstate). Most recently, Thomas was involved in an international arbitration relating to the termination of an IT services contract. Before being called to the bar, Thomas was a Special Counsel in the construction and infrastructure disputes department of a national firm in Brisbane. In that role, he acted for leading construction, infrastructure and services companies, developers, mining companies, external administrators and the State of Queensland (through various government entities). He was involved in appeals to the High Court of Australia, high value disputes in the State and Federal Courts (including the Land Court), arbitrations, expert determinations and security of payment adjudications (including reviews of those decisions). |
![]() | In the role of Narrator - Stephen Burton Stephen is the national head of the Construction, Infrastructure and Projects team at Holding Redlich. Stephen has significant major international and local project experience across the commercial construction, mining and infrastructure sectors. He specialises in dispute management with extensive experience in mediation, arbitration, expert determination, litigation and claims under the security for payment legislation nationally. Stephen provides regular in-house training for clients in relation to the management and resolution of project disputes and also conducts training on behalf of recognised industry peak bodies such as Engineers Australia and the Civil Contractors Federation. Stephen also regularly conducts training for registered Adjudicators nationally. Since 2019, Stephen has been listed in The Best Lawyers in Australia publication in the area of Construction & Infrastructure and in Doyles Guide since 2017. |
![]() | In the role of Solicitor - Kirsty Smith Kirsty Smith is a partner in Holding Redlich’s Construction, Infrastructure and Projects Team, specialising in the resolution of disputes. She is experienced in litigation, expert determination, mediation and arbitration concerning a wide range of issues on construction projects that often lead to complex negotiations, disputes and settlements. Kirsty works as part of a specialised team to achieve objectives set by clients, including coordinating high pressure adjudication proceedings. Those successful outcomes are founded on her dedication to her clients as well as her pragmatic approach to advising on strategies to overcome obstacles throughout the delivery of a project and beyond. She operates across all jurisdictions in Australia for contractors, consultants and principals, including government. |
